Abstract
India has laws to protect a person’s intellectual property when it comes to intelligence. The Indian Patents Act, passed in 1970, lays out the guidelines for granting intellectual property rights to those who create novel and ground-breaking innovations. With the development of technology, AI is now able to create original concepts that are patentable. However, the pertinent question to ask is if our current legal system acknowledges AI as inventors, and if so, what benefits and drawbacks there may be. Therefore, the objective of this paper is to research on the fundamental principles of patent law that must be considered in this context as well as the legal ramifications of patenting AI.
